If a person doesn't stay in Mina on the 11th, and 12th night deliberately
Does he have to give dam?

الجواب
It is very unfortunate and big deprivation for a person who is on holy land and intentionally abandons this Sunnah i.e. not spending his 9th, 11th and 12th night in Mina.
O my brothers and sisters what has happened to you ! Come out of comfort zone. Millions of Muslims who are day and night desiring for Hajj but they are unable to afford the expenses. You are fortunate enough to get this opportunity and want to intentionally miss the Sunnah of Mina.
Are you sure that you will get another chance of Hajj and to be guest of Allah ?!
The Prophet of Mercy Prophet Muhammad peace be upon him himself spent these nights in Mina. Imam Abu Mansoor Muhammad bin Mukarram bin Shabaan Kirmaani Hanafi 593 AH has stated:
ان النبی صلی الله عليه وسلم بات بمنی لیالی الرمی وھذہ البیتوتۃ سنۃ عندنا
"Indeed, Prophet peace be upon him spent nights of pelting (Rami/ رمی) in Mina. This spending of nights in Mina is Sunnah according to us"
(📕Al Masaalik fi Al Manaasik 1/593)
Allama Syed Muhammad Amin ibn Abideen Shaami 1252 AH has written:
فیبیت بھا للرمی ای لیالی ایام الرمی ھو السنۃ فلو بات بغیرہ کرہ ولا یلزمہ شیء
"Pilgrim will spent his nights of pelting (Rami) in Mina and this is Sunnah and if he spends at some other place other than Mina it is a disliked action and there will be nothing upon him."
